The Global Travel Blog Terms of Use and the Flight Centre Privacy Policy

This Agreement applies to you if you only browse the content on the Service ("Casual User"). As a Casual User, you agree to be bound by this Agreement when you use the Service.

This Agreement also applies to you if you register as a member of the Service ("Registered User"). If you want to become a Registered User and use all of the features of the Service, you must indicate that you agree to be bound by this Agreement during the registration process.

1. Description of the Service

1.1 Global Travel Blog is user-generated travel website that allows Registered Users to create unique personal profiles and interact with other Registered Users and Casual Users ("Service").

1.2 The Service is provided by Flight Centre Limited ABN 25 003 377 188 ("we" "us" or "our").

2. Eligibility

You must be at least 16 years old to use the Service.

3. Charges

The Service is free. However, we reserve the right to charge for the Service in the future.

4. Username and password

4.1 You are responsible for all text, images, audio clips, video clips or other material ("Content") posted on the Service under your username and password.

4.2 You are responsible for maintaining the confidentiality of your username and password. You agree not to disclose your username and password to anyone or permit anyone to access your account. You should tell us immediately if you suspect any unauthorised use of your account or access to your username and password.

4.3 You also agree not to use another Registered User's username and password to access the Service, either with or without their permission.

5. Permitted use

5.1 You may only use the Service for personal use.

5.2 You may not use the Service:

1. to commit, or facilitate the commission of, a criminal offence or breach any law;
2. for commercial purposes such as selling:
   1. any part of the Service;
   2. the use of the Service; or
   3. access to the Service;
3. to collect email addresses of users of the Service and send them unsolicited communications of any kind;
4. to send commercial advertisements, affiliate links or any other form of solicitation to users of the Service to buy or sell goods or services;
5. to distribute in any medium any part of the Service, including other users' Content;
6. to display an advertisement in the Content that you post on the Service;
7. to monitor or copy Content on the Service using a robot, spider or other automated system;
8. to transmit malware, viruses or otherwise harmful computer code;
9. to alter or modify any part of the Service; or
10. in contravention of applicable local, national and international laws and regulations.

6. Intellectual property

6.1You retain all right, title and interest in and to the Content that you post on the Service. However, by posting Content on the Service, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable license (with the right to sub-licence any or all of the following rights) for us, our related bodies corporate (as that term is defined in section 50 of the Corporations Act 2001 (Cth)) and our subcontractors to use, reproduce, publish and distribute the Content that you post on the Service in connection with the Service and for the reasonable purposes of our business (including advertising and marketing). You also grant other users of the Service a non-exclusive license to access the Content that you post on the Service through the Service, and to reproduce and display the Content that you post on the Service through the Service. This licence grant does not give us the right to sell the Content that you post on the Service.

6.2 To the extent permitted by applicable law, you agree to waive, unconditionally and irrevocably, your:

1. rights of integrity of authorship;
2. rights of attribution of authorship; and
3. rights not to have authorship falsely attributed,

that exist in the Content that you post to the Service.

6.3 The Service contains Content which we or our licensors own. We or our licensors also own all right, title and interest in and to the Service (including intellectual property rights). We grant you a limited, revocable licence (without the right to sub-licence any of the following rights) to reproduce and display our Content through the Service solely for your personal use.

6.4 You may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display or sell any Content on the Service (other than the Content that you post on the Service).

7. Content restrictions

7.1 You are solely responsible for the Content that you post on the Service and the consequences of posting such Content on the Service. We reserve the right, but have no obligation, to monitor the Content that you post on the Service.

7.2 You may not post Content on the Service that:

1. is illegal or unlawful or promotes illegal or unlawful activity;
2. is pornographic, sexually explicit, violent or obscene;
3. requests personal information from a person who is under 16 years of age;
4. is racist or hateful or promotes racism or hate towards another person or group of persons;
5. is threatening, abusive or harasses another person or group of persons;
6. infringes any person's intellectual property rights, including copyright or trade mark rights;
7. is defamatory;
8. is a false statement about a person or their property or business which is actuated by malice and may cause financial harm to that person;
9. impersonates any person or business or otherwise misrepresents your affiliation with a person or business;
10. is misleading or deceptive;
11. promotes or describes a business, service or product unless such Content accurately describes all relevant aspects and attributes of the business, service or product including any references to price;
12. is a breach of confidence or an invasion of a person's right to privacy;
13. may cause us to breach, or be involved in a breach of law, a code or an instrument which governs our conduct;
14. may result in us incurring liability to any person; or
15. we consider could adversely affect or prejudice our reputation or brand or that of any of our third party preferred suppliers.

7.3 If, in our sole opinion, the Content that you post on the Service breaches this Agreement, we may immediately take appropriate remedial action without notice to you including:

1. refusing to publish the Content that you post on the Service;
2. editing the Content that you post on the Service (either before or after it is published);
3. taking down the Content that you post on the Service;
4. warning you that any further repetition of your conduct will result in us immediately terminating your membership to the Service;
5. terminating your membership to the Service; and / or
6. reporting your activities or conduct to relevant authorities.

7.4 Whilst there are currently no usage or storage limits for the Content that you post on the Service, we reserve the right to create usage and storage limits in at any time without notice to you.

8. Copyright policy

If you believe that your copyright has been infringed by Content on the Service, please Contact Us.

9. Privacy

9.1 We will collect, use and store all personal information that you provide to us in accordance with our Privacy Policy (http://www.flightcentre.com.au/aboutus/policies/privacy.jsp).

9.2 Your profile must not include your telephone numbers, street addresses or any other information that users could use to identify you. If you post personal information on the Service or make it available to other users of the Service, you do so at your own risk.

10. Disclaimer

10.1 We provide the Service to you on an "as is" basis. As such, you use the Service at your own risk.

10.2 Except for those warranties implied by law that we cannot exclude, we expressly exclude all express and implied warranties in relation to your use of the Service. We make no warranties or representations about the Content on the Service or the Content on third party websites linked to the Service. For those warranties that we cannot exclude, our liability is limited to resupplying the Service to you or paying the cost of resupplying the Service to you.

10.3 We are not responsible for, and expressly exclude liability for, any loss or damage that you may suffer as a result of any:

1. Content on the Service, including any errors, omissions or inaccuracies in the Content on the Service;
2. deletion of or failure to store or transmit any Content on the Service;
3. personal injury or property damage arising by reason of your use of the Service;
4. unauthorised access to your personal information stored in our databases; and
5. faults or viruses which a third party may transmit to your personal computer as a result of your use of the Service.

10.4 In making the "Jobs for Travellers" section of the Service available to you, we are not representing that we are an employment agency, not are we representing or warranting that we will be able to secure employment for you.

10.5 In making the "Travel Items Wanted" / "Travel Items for Sale" section of the Service available to you, we are not representing that the Service is an online auction site.

11. Warranty

11.1 You represent and warrant that:

1. you have the necessary right, power and authority to enter into this Agreement and perform your obligations under it;
2. you own the Content that you post on the Service or you have the necessary right from the lawful owner of the Content to post it on the Service;
3. the Content that you post on the Service complies with clause 7 (Content Restrictions); and
4. you will pay any fees, royalties and other monies owing to third parties (including collection societies) for the Content that you post on the Service.

12. Indemnity

You agree to release and indemnify us against any loss, damage, liability, claim and expense (including on a full indemnity basis all legal, defence and settlement costs) which we may suffer or incur arising by reason of your use of the Service in breach of this Agreement.

13.Limitation on liability

We expressly exclude all liability to you for, or in respect of, indirect or consequential loss, including loss of use, loss of profits, loss of expectation, loss of goodwill, loss of data, loss of production, loss of opportunities or business interruption arising by reason of your use of the Service.

14. Termination

14.1 You may terminate your membership to the Service at any time for any reason (or no reason) by following the instructions on the [insert] page.

14.2 We may terminate your membership to the Service at any time with or without notice to you if you breach this Agreement.

15. Changes to the Service

We may modify, suspend or discontinue the Service at any time in our sole discretion with or without notice to you.

16. Changes to this Agreement

16.1We may change this Agreement at any time in our sole discretion with or without notice to you.

17. Linked third party websites

17.1 The Content on the Service may contain links to third party websites. You should not construe such links as an endorsement, approval, recommendation or preference by us of the owners or operators of those websites, or of any material, products or services referred to on those websites. Your use of a linked third party website is at your own risk.

17.2 Unless stated otherwise on the Service, we have no relationship with the owners or operators of linked third party websites and no control over, or rights in, those websites.

18. Member disputes

We reserve the right, but have no obligation, to resolve disputes between you and other users of the Service.

19. Other

19.1 This Agreement constitutes the entire agreement between you and us about your use of the Service.

19.2 Our failure to exercise or enforce a right under this Agreement will not constitute a waiver by us of such a right.

19.3 If a court holds that any clause or part of any clause in this Agreement is invalid or unenforceable, that clause or part of a clause is to be regarded as having been deleted from this Agreement and this Agreement will otherwise remain in full force and effect.

19.4 This Agreement is governed by the laws of Queensland, Australia.  You submit to the non-exclusive jurisdiction of the courts of that place and the courts of appeal from them.
